Given that this was Boeing and the entire American "Free Press", the Indian Investigators saw what was coming. Days before even releasing the preliminary report, the Wall Street Journal ran an article saying “Air India Probe Puts Early Focus on Pilots’ Actions and Plane’s Fuel Switches.” I suspect the Indian investigators knew they had to be just vague enough with the preliminary report, to keep the American ecosystem off their backs by the time they completed their findings. And this ecosystem, by the way includes people like "Captain" Steeeeve, whose first theory (that he put out in quite an unusual hurry), was that the pilots "forgot" to extend the flaps before takeoff.

I am indian and we all know that getting any information from the govt is not easy, and probably not reliable. What capt Gary said is right- if it was an easy answer, they would have answered it.

Whether it is pilot error or aircraft error, some party will be in trouble, and unfortunately the pilot is the only one who cannot hire an expensive legal team.

I'm getting deja vu from the EgyptAir 990 crash. The Egyptians, to this day, will still say it was a design flaw on the 767 despite the 767s safety record.

My son is an attorney and he told me eons ago. "If" a judge would deny a potential suit on lack of merits the courts wouldn't be SO inundated with egregiously lawless cases.

Suing the captain is absolutely crazy. Greedy lawyers should be disbarred and the court should award the estate the cost of this frivolous suit.

Great post! My family, we have pilots all the way back to the barn stormers, to one of my kids setting up the helicopter program for a sheriff's dept. It was very interesting about 6-7 mos ago a brand new chopper was breing flown by my child and all of the lubricant spewed out of the rotor mechanism, thank God, he landed it without any damage to the chopper or him. I know how lucky this was. It happened again after this issue was "fixed" w/ a differ pilot and he was also able to put it down w/o any damage to the aircraft or him.This all happened when this craft had only a few miles on it. Crazy!!

As far as the MD11, I think after this, they need to do an audit about other issues that may have been flagged that have been deemed not likely to cause an accident.
