Honestly, if we added copyright laws for fashion, it would immediately be used to destroy like 70% of small designers for the benefit of big labels. There are huge problems with the lack of copyrighting, but I don't think expanding copyright law is the answer. Imagine if, like, bellbottom jeans were owned by a single company. Or strawberry dresses. Or the concept of the stiletto heel.

Not only does the issue with fashion copyright affect independent businesses but also cultures that have had designs appropriated by bigger fashion houses. One of the more notable cases I remember was when Isabel Marant tried to copyright a blouse pattern that was similar to a Oaxacan huipil. Luckily there was enough outrage and Mexico declared the patterns to be protected under UNESCO guidelines. While that is a protection that isn’t legally binding, it’s still the best protection provided for these situations.

i want independent artists to be able to protect their creative and intellectual property
but i dont want mega powerful billion dollar brands to be able to exploit the system and copyright the black leather belt or the tote bag and ruin any other creators ability to use these styles as a base or inspiration for their creative ideas

As a plus size person ive tried to shop from original stores, small businesses, etc, and its impossible to find any plus size friendly brands that are past a 3x. My bust size (59 inches round) is bigger than most stores carry by 10 inches. Most small stores only go up to XL. I am not judging these businesses, i shop consciously aswell, exclusively thrifting nowadays. Its just very frustrating trying to navigate fashion as a plus size person. Our only options are dolls kill, forever21, fashion nova, and shein if we want to be even remotely trendy, we dont have the option to buy small.

Fashion copyright and inspiration is a nuanced topic. I personally do not foresee copyright laws improving. You sound a bit astonished by the fact that you can't copyright designs. A print/pattern is unique to the textile artist/designer that made it, but the silhouette isn't. As a fashion designer, if I want to make a similar silhouette, I am able to. It's not an exact copy. A pleated skirt. A little black dress. A corset-style top. These are silhouettes/designs that are not specific to any one designer. BUT, if I were to design something using the same colour palettes, materials, and design details (lace, chains, ruffles, etc.) ON TOP of using the same silhouette, then it is copying. There is nothing wrong with inspiration. But people like Danielle who completely steal a design in its entirety small creators are not 'fashion designers". She's shown that she purposely copies from others because she has no originality.

in my mind, danielle just walks into her closet every day and picks something she likes and goes “wow, this is in my closet so this must be my original design and i should start selling this! :)”

you should do a video on Belle Gibson, a super famous influencer who faked her cancer. Her story is really interesting and the effects she had on some people is so sad. I think you would find it really interesting :)

It’s not so much “girlbossing” as it is capitalism. Capitalism encourages theft for profit. It’s just girls doing it and being bosses but at the root of the problem is the economic system itself. But anyway great vid :)
