Small correction: Richard Shaw wasn't replaced by Ashok; they were both in the band at the same time, debuting on 'Hammer of the Witches' and playing together on both 'Cryptoriana...' and 'Existence is Futile', after which Shaw left...
4:16 The music industry feels like every other job I’ve ever had. She expressed it very intelligently, I must say. I’ve worked in companies where, despite being part of the same organization, the atmosphere and attitude were completely different. The people you work with can make or break the experience. Always remember that when you’re working with others—do your best to treat them properly.
10:16 it's formatted that way because the document was edited with 'Track Changes' enabled, the striked-out text was deleted during the changes and the underlined red text was added during the changes. It helps you see/track what was modified.
Sounds like Dani & Dez's hubris might be coming back to bite them... the copyrighted sigil & defamation claims in particular seem pretty strong right off the bat, as there is a paper/digital trail of evidence.
Usually a big hurdle for defamation is proving that the defamatory claims aren't true and in the case of a public figure, that the harmful lies were spread with intent to damage your reputation (`actual malice')... well in this case, Zoe not only has medical evidence that Dani lied about her miscarriage but also the public tweets showing Dani's intentional & unprovoked attack on her professional reputation. And if Dani has a history of maligning other ex-members' reputations in the same way... stick a fork in him, he's done.
As for the compensation & contractual allegations, it should be easy for Dani & Dez to refute the claims by simply presenting the signed contracts & receipts... assuming, that is, they actually exist. I can see that part getting really messy if the ex-members ever signed agreements of any kind that could have had sneaky clauses in them... that's why you always get a contract reviewed by a lawyer.
Kudos to all of the plaintiffs for taking this to court. 🤘 Lawsuits are a serious commitment & draining in every way possible - on your finances, time, mental & physical health, working & personal life... and that's what a-holes like this pair count on when they treat you like crap.
Cheers for covering this while you're on holiday Wyatt... it's definitely worth keeping an eye on 🤘😎 (btw, to turn off all that red editing text & crossed out words there's a setting in Word called 'Mark Up' - just deselect it. Whoever uploaded the file just forgot to turn off the editing view before they saved it, and they're probably kicking themselves right now! LOL)
This is so wild but also saw it coming because a few years ago here in Minneapolis, the band performed here and then I later ran into them out of their makeup/costume at a bar next door to the venue about an hour after their show ended. I had actually unknowingly struck up a conversation with Richard Shaw at the bar as he was there before the band and he was very chill, very down to earth and fun to chat with. Eventually the band walked in and I realized who I was chatting with because he ushered the rest of the band to a table and invited me to come chat for a bit. I was at one point sat alone with Dani as the rest of the band walked over to the bartender for drinks and it was so awkward and he was so aloof the whole time I sat with him. Eventually the band came back and we all chatted in our own side conversations but Dani was just so quiet and detached from most of us that night and I eventually struck up a conversation with their manager at the time who told me something very personal about themselves that I asked why they didnt choose to share that information with the other band and the manager immediately dropped his smile and said "someone in the band would fire me if I ever told them." and I was immediately aware who he was likely referring to. Anyways the band later left to a party with Dani yelling at everyone pretty rudely to get their asses back to the bus immediately before Richard and others said goodbye to me.
To this day I attribute that live show to being one of the worst live performances I've seen (I've seen hundreds of shows as I work in the industry) and I attribute Dani to being the main cause of tension in the band as well as one of the sole reasons for the shitty performance since he decided to have a huge attitude the entire time during his performance that was palpable in the entire venue and on stage.
I actually remember this from when I took business law, not a lawyer btw, but it was so I could get a trade license. "False designation of origin" claims are when one party accuses another party of using trade material (could be physical product, a symbol, a name, etc) in such a way as to cause confusion of the source of that material. Like if I were to sell Wyatt's Metal shirts with the Wyatt's Metal logo on them claiming they were for my brand UvUyacht Metal or something.
