Legally, surviving a botched execution does not trigger double jeopardy. In 1947, the U.S. Supreme Court ruled in Francis v. Resweber that double jeopardy applies to multiple prosecutions, not an accidental failure to carry out a lawful sentence, so the state is allowed to try executing the person again.
