Why No One Was Charged in the Cornell Frat Case (And Why the DA Is Reopening It)

A former Cornell University student is suing seven members of the Chi Phi fraternity, alleging they assaulted her at the fraternity house in October 2024. Her lawsuit, filed September 16th in New York, also names Cornell, the fraternity and its national organization, her sorority, Tri Delta, and Moonies Bar & Nightclub, which she claims served her while she was underage.

According to the lawsuit, the men were temporarily suspended after she reported the incident, and were given the opportunity to reduce their discipline by writing essays. Her attorney says two were later expelled following a Title IX investigation.

But the Tompkins County District Attorney says no charges were filed in 2024 because the sworn statement she gave police back then is very different from what's in her lawsuit, and did not meet New York's legal definition of a crime. Her attorney disputes that, saying she was never interviewed by investigators trained to speak with survivors.

Now, the DA is reopening the case and preparing to present it to a grand jury.

None of the men have been criminally charged, and the allegations in the lawsuit have not been proven in court.

While it’s concerning that she originally appears to consent to 1 guy she found attractive. I highly doubt that she consented to anyone sending out a text about gang assault.

Weird. According to the DA she wasn't accusing them of anything... so why did she go to the police? Huh? For no reason? I highly doubt that she went to the police just to tell them about hard partying with no crime.

As someone who is a licensed attorney (in Georgia), I think that most of the men will be indicted, but few will be convicted. The NY standard for consent is tough on victims and Jane Doe's prior statement will likely constitute reasonable doubt for most assailants. Very tragic event, I pray that she is able to heal and thrive.

One of the things my time in college at a school like this taught me was if I never needed police for anything serious was to go to the local police first no matter what. University police officers will always have a conflict of interest between you and the university. While they are helpful for some things, like getting around safely late at night or campus specific threats, never go to them first for anything that could potentially embarrass the university’s reputation. Anything regarding interpersonal violence, sexual misconduct, or something along those lines go to local police first so an investigation can be done properly (if pressing charges is something you may be interested in) and so the university has a harder time if they try and do a cover up. It also makes it harder for a university to violate the Clery Act.

Once she said no and I don't want to participate anymore it became a crime...once other ppl came in and started sexual activity with someone inebriated they were committing a crime.

The campus police, paid for by the university, wrote the statement narrating what suits their bosses??? Jane Doe never gave any written statement and was never interviewed by SA-trained detectives in the presence of the victim's advocate. BTW "FREE P** upstairs, PULL UP" and "SHOP is STILL OPEN" going around for hours sounds like what to you??? It was r*** and sex trafficking. Disgusting!

I must tell ya'll as a person who used to be in a sorority.m this happens so often and the schools cover it up... fraternities have killed students.. all type of stuff and nothing has been done .. its disgustingand they need to do away with them
