What happens when a surrogacy contract breaks down over a devastating medical diagnosis? Today, we’re reacting to the complex and heart-wrenching real-world case involving a gestational carrier, intended/genetic (read: DEFINITELY THE RIGHTFUL) parents, a rare and devastating fetal diagnosis of Hypoplastic Left Heart Syndrome (HLHS), and a legal battle across state lines. The result? A twin pregnancy where the babies are not biologically related at all.

i don’t see any reason whatsoever not to keep each unrelated “twin” with their biological parents. that case just seems like a non issue to me

Language is powerful. So 'intended parents' rather than 'genetic parents' and 'actual mother' are designed to lead the viewers in a specific way.

The "Texas" case is in Texas because somebody paid the surrogate to move there and act as a plaintiff to get a Texas decision that sets up a SCOTUS case. They're looking for a personhood ruling.

I feel like the australian court got involved with the first case juat ao they could have a ruling on paper to have precedence if this happens in the future and there is a disagreement over it. Now they can say the law is alreasy defined.

Most of the media coverage around the second case never mentions that there was also a court ruling in Alaska. Those court proceedings revealed that the gestational carrier initially agreed to the abortion along with the birth parents. It also revealed the parents changed their mind when they had a second opinion and assembled a care team for Rumi in CA. So I personally believe that kidnapping or child endangerment charges should be brought against the carrier because of the vast difference of healthcare able to be received in CA vs TX, especially given that the parents had already assembled a care team in California that knew of Rumi’s specific care needs.

The Texas case infuriates me as a GC myself. There have been a few things brought out that are missing but the information may not have been available at the time of the video. After refusing the abortion, the parents put together an excellent care team for the baby after birth, the GC refused additional testing and refused to share medical records. It is my understanding the lack of tests and records delayed the first surgery. The parents are suing West. In a separate case, one of West's children's father is asking for sole custody of their child. I believe West absolutely should not have conservatorship of this child (it's also rumored she was going to let her brother adopt the baby), she absolutely violated the contract and should be held accountable.

On a happy note, my friend (who had 3 easy pregnancies) decided to be a surrogate for a high school friend. Tbh they were not close during high school and basically were in the same crowd. She ran into her at a reunion and mentioned she could not have children. My friend volunteered (which surprised me because they were not close). Anyway long story short it was a positive experience. In Canada surrogates can not be paid unless it is something to de regarding the pregnancy (vitamins, clothes, childcare for her children while she attends medical appointments). My friend was carrying twins. Her children knew they were for Aunt B and Uncle C (the names were given with affection). My friend had all her needs met by this couple including putting in central air, swimming pool, maid once a week plus full time daycare (which my friend never asked for). The babies were born naturally. Both couples present and the surrogate’s mother as per request. Boy and girl. My friend is godmother to both. They all have a close and loving relationship. As a gift B and C paid for a week vacation for my friend and her husband. The twins are in university. They know. But my friend said to them that these are your parents I was just the vessel.

My friend has done two surrogacy journeys. She did not want to terminate a pregnancy. So at the very beginning, before any potential matching occurred, that was stipulated. And the parents could either approve that stipulation or not match and move on. This surrogate has no legal ground to stand on. I feel terrible for the baby and the parents

With the first story they were more like room mates than twins. Both sets of parents can tell it to the kids like it is just a quirky story about their birth. It is good that the parents are letting them know each other.

We all know why she fled to Texas. She came here because Paxton, Abbott, and Patrick would protect her, and she, and they, could use this for attention and money making. I don't believe any of them care about that baby's well-being.

It should also be noted that in Australia, surrogacy is only allowed to be altruistic rather than a financial agreement. So the relationship between gestational carrier and intended parents is already very different to those where the agreement is purely financial.

My friend's daughter was born with hypoplastic left heart syndrome... She just started high school this year. She is on the autism spectrum, she has Tourette's Syndrome. She spent the first 11 months of her life in the hospital. She took years to learn how to chew and swallow because she was raised on a feeding tube... She's had several open heart surgeries. She can't do any sports, and can't even do a full school day. She brings love and joy to her family, but the road has been extremely difficult.

Not only did she want to gain custody... She expressed a desire to have her BROTHER raise the boy... We have him adopt the child.

This is crazy. The second story is so sad. My second child was born with hypoplastic left heart syndrome and passed after her second open heart surgery at 6 months old. It was awful. I’m still haunted but in between surgeries we tried to live as normal as possible. It looked a lot different than normal normal. Between 12-14 med doses a day. Vitals weights taken daily and called into the cardiologist. So many appointments and cath labs. It affected us so much. But guess the selfish part of me is glad I got time with her, see her personality, her smiles and coos. I feel guilty but I also didn’t want to abort her in case she survived. Her previous hospital roommate with the same condition, same age, same surgeries and surgeons is thriving.

If the argument is that TX has stronger personhood laws, not allowing abortion because life begins at conception, then shouldn’t this be considered kidnapping since there is already a standing contract with the biological parents that the gestational carrier is only supposed to maintain custody until birth, and definitely not be allowed to make medical decisions for another couple’s child?

Im sure i read somewhere that west was being sued by her ex, he seeking sole decision-making authority for their son, claiming that amid her dispute with the Californian couple, she had actually fled to Texas to avoid legal troubles in Alaska and that he feels this is a clear indication that she’s not stable enough to make decisions in regard to their son.
