A Cleveland Heights police officer cut off a driver on Mayfield Road, nearly caused a collision, and apologized for it. Ten minutes later that driver was in handcuffs — arrested by her supervisor, seconds after she said on her own body camera that no crime had been committed.
On September 22, 2022, Officer Carly Lewis changed lanes without a turn signal to pull over a silver Infiniti and cut off Demetrius Kern's Tesla. Kern braked hard, avoided the crash, pulled over, and asked for her badge number. Lewis told him to wait; he waited. When she came back, they argued about whether her lights and sirens had been on. Her supervisor, Sergeant Naftali Wolf, arrived, told Kern that what he was doing was illegal, and demanded identification. Kern refused. Lewis then told him there was no crime — and Wolf arrested him for obstructing official business anyway, ordering Lewis to write the citation after she said she was willing to let him go.
Eleven days later the Cleveland Heights city prosecutor moved to dismiss the charge for lack of probable cause. Kern sued in federal court. Both officers were deposed on video. On March 30, 2026, Judge Charles Fleming ruled — and found there had been no probable cause to arrest at all.
