If it stipulates that persons are not required to enter the country at a designated port of entry, It then allows foreign criminals to come into the country under a guise of Asylum seeking. They can commit any acts of criminality and flee the country. Can anyone come into your house even by a window and should you find them, and they claim seeking safety? That's a stupid judgment.

I'm not a legal guru but I can tell that the Concourt grossly erred in its judgement. It did not take the security interests of the citizens into consideration. Right now we are scared as South Africans because the judgement has the potential to open the floodgates for more undocumented migrants coming over to SA under the guise of seeking asylum. According to the ruling they cannot be turned back or arrested. This is the price the citizens pay when the fate of the country is determined by a few judges.

People must Repent for selling the nation.

In this court judgment, the court said that the Department of Home Affairs' Minister handled the entire case with absolute "gross ineptitude and egregious laxity" (basically, total incompetence and extreme laziness). If you look at pages 25 and 26 of the judgment, specifically under paragraph 50, Justice Majiedt called them out for completely messing up their legal paperwork. The department filed their appeal more than two months late, didn't even bother to ask the court for forgiveness or explain why they were late, and used the completely wrong court rules to file it. The judge basically said that Home Affairs either didn't know the rules or just didn't care that they were breaking them, which is completely unacceptable for a government department that is supposed to uphold the law.

Unfortunately leadership has been concerned about Palestine more than Taking Care of the Needs of South Africans.

This Con Court keep say  our laws  are unconstitutional. So must the Judges become law makers instead. What’s the point of parliament if con court keeps forcing us to change laws?

I'd like to ask a question: Does the South African government receive any money from the UN or from any other group?
South Africans are living like refugees in their own country and are struggling, yet government insists on some people be given refugee status!
It looks like they are getting funding for it, and somehow, they are looting those funds, and hence, they continue with the narrative to allow people to apply for refugee status!
By the way, how do you give people who break the law by entering a country illegal, then reward them with refugee or asylum?
South Africa is the only country in the world where a refugee goes back to their home country for vacation!

So long as South Africa remains a signatory to the UN Refugee Convention without any reservations, current efforts to introduce White Papers and new legislation will prove futile. In this situation, South African citizens are simply being made fools of. The Department of Home Affairs is captured, a reality that the media has been incredibly slow to recognise.
