Today's Case:
A Greeley police officer testified that Abel Verdugo Felix kicked him in the back during an arrest that began as a welfare check on a barefoot man standing in the middle of 10th Avenue. At the preliminary hearing, the officer admitted he never saw a foot hit him and couldn't say whether it happened before or after handcuffing, and the only other officer on scene saw no kick either. After watching the body camera video several times alongside the testimony, the judge found it didn't show contact and that contact was "nearly impossible" given where the officer was kneeling, and he also found no proof of intent to injure. The felony second-degree assault charge was dismissed, though the judge noted Felix was clearly resisting arrest, so the misdemeanors moved to county court with a new bond hearing.
