On Tuesday, Senator Katie Britt used her time at the Senate Judiciary Committee hearing to grill former Special Counsel Jack Smith over Arctic Frost. She tried to tie his case to FBI agent Timothy Thibault and called it fruit of the poisonous tree. But Thibault retired in August 2022, three months before Smith was even appointed. A federal watchdog later closed its case against Thibault with a warning letter, sent to a man who had already left government.

Britt's sharpest questions were about the secret phone record subpoenas and the gag orders that came with them. The judge who signed those gag orders most likely never knew the numbers belonged to senators, because the requests usually list only a phone number. Career lawyers in the Justice Department's Public Integrity Section flagged some legal risk, called it minimal, and approved the subpoenas anyway. And Trump's own Justice Department did the same kind of thing in his first term, secretly subpoenaing records of two Democratic congressmen and 43 staffers, including a young aide named Kash Patel.
