On episode 1113 of the Immigration Answers Show, immigration attorney Jim Hacking answers 11 live questions on I-130s, N-400 forms, DS-160 mistakes, asylum, and stuck I-485s.
QUESTIONS ANSWERED
(General information, not legal advice for your case.)
My spouse filed an I-130 two years ago but never filed an I-485. What now?
An I-130 alone doesn't give you status. Long delays, living apart, and a pending asylum case will all draw scrutiny.
How do I list my name and employment gaps on the N-400?
Use the name on your green card and list other versions under "other names used." For a gap between school and work, list the dates as unemployed.
I got two identical RFEs, and one still shows as open. Should I respond again?
If your lawyer agrees, resending the same response is a low-cost safeguard. Also correct any missed answers, like organization memberships, before the interview.
I listed an organization on my DS-160 but not my I-485. Is that a problem?
Jim doesn't think a one-time volunteer shift is material. If you're unsure how to answer on the N-400, have a lawyer review it.
My I-751 mandamus was filed three months ago. Why no movement?
Government extensions are normal. Expect an interview or decision soon. Filing the N-400 when eligible can also move a stuck I-751.
I-130 approved, but my I-485 is still pending months after the interview?
Many cases stall at this stage right now. After a long wait, a mandamus lawsuit is a reasonable next step.
I listed a former spouse on my DS-160 on someone's advice. Is that a problem?
Yes. It's a false statement on a visa application. Get legal advice before filing anything else.
Pending asylum and marrying a green card holder. Should I wait for my spouse to naturalize?
An asylum case filed while you were in status may let you adjust through a green card holder, though USCIS doesn't always agree. Jim suggested filing now and uploading your asylum evidence.
Marrying a U.S. citizen soldier while I keep working abroad. When should we file?
Filing an I-130 shows immigrant intent, which can make a visitor visa harder to keep. If you plan to stay abroad for years, waiting may make sense.
I withdrew my N-400, but I got an interview notice anyway. What now?
Keep proof USCIS received your withdrawal, keep contacting them, and document every call. USCIS isn't required to accept a withdrawal.
EB-3 I-485 pending after a good interview?
Employment cases are getting heavy scrutiny. If there's no decision within a year, consider a lawsuit.

Maybe this administration could try a revolutionary new strategy: actually following immigration laws exactly as written, instead of treating the rulebook like a "choose your own adventure" novel.
