न्यायाधीश व्यवहार की मर्यादाओं से बँधे रहते हैं । पर पिछले कुछ समय से न्यायाधीशों को ऐक्टिविस्ट बनने के बीमारी लग गई है। रिटायर्ड जज तो ऐसे बोलते हैं कि पार्टी के प्रवक्ता भी शरमा जाएँ। इनके विचारों को सुनकर समझ में आता है कि जब जज थे इनके फ़ैसलों पर इनकी वैचारिक प्रतिबद्धता का कितना असर रहता था । पर। अब बात उससे आगे चली गई है। सुप्रीम कोर्ट के एक कार्यरत जज ने सुप्रीम कोर्ट के फैसले को प्रभावित करने का प्रयास किया है । ऐसे मुद्दे पर सार्वजनिक टिप्पणी की है जिस पर अगले ही दिन मुख्य न्यायाधीश की पीठ सुनवाई करने वाली थी। क्या सुप्रीम कोर्ट के सिटिंग जज और एक राजनीतिक कार्यकर्ता में कोई फर्क नहीं होना चाहिए।

If, along with loyalty to the family, you are also opposed to Sanatan traditions and are willing to go to the extent of taking positions that are seen as being against the country, then, according to this line of argument, no one could be considered more suitable.

In Uttar Pradesh, two such individuals have been rewarded with important positions.Judges are bound by the conventions and decorum of judicial conduct. But in recent times, some judges seem to have developed a tendency to become activists. Retired judges sometimes make statements that even political party spokespersons might hesitate to make.

Listening to their views raises questions about how much their ideological commitments may have influenced their judgments when they were still serving as judges. But now the matter has gone a step further.

A sitting Supreme Court judge has publicly commented on an issue that was scheduled to be heard by the Chief Justice’s bench the very next day, raising questions about whether such a comment could influence the proceedings.

Should there really be no distinction between a sitting Supreme Court judge and a political activist?
