Proteger la propia vida no es solo un derecho, es también un deber (Immanuel Kant). Por eso, el derecho penal contempla la legítima defensa, que incluye la protección de la propia integridad y la de terceros, en este caso los familiares, lo que en derecho se conoce como impulso de protección familiar.
Desconozco si alguna de las actuaciones judiciales de la magistrada César Siero estuvo al margen de la ley, sin coacción alguna y sin estar comprometida la propia integridad y la de los suyos. Eso deberá ser investigado judicialmente. No podemos hacer conjeturas a priori. Por eso en derecho existe la presunción de inocencia, el derecho a la defensa y el debido proceso.
Ni la nobleza característica del venezolano, ni la Constitución venezolana contemplan el principio del ojo por ojo. Lo que sí contempla es la justicia, que debe considerar no solo parámetros legales, sino también morales y éticos, además de los circunstanciales.
No podemos convertirnos en aquello que reprochamos. La ley y la justicia se deben considerar y aplicar al margen de emocionalidades. Por eso el deber de inhibición del magistrado y del juez (motu proprio) cuando su imparcialidad se encuentra comprometida.
¿Habrá posibilidad alguna de poder contar algún día en Venezuela con instituciones dignas? ¿Es viable un TSJ realmente institucional, con magistrados y jueces imparciales, con capacidad y voluntad de investigar y proceder con justicia, apegados a la ley y al derecho?
