Gregory Kusguard appeared in Three Rivers facing operating while intoxicated and resisting-and-obstructing charges after a February 19 traffic stop. Police said they clocked him at 60 mph in a 35 mph zone, later recording 64 mph, before he continued driving after emergency lights and siren were activated. At the vehicle stop, officers said Kusguard refused repeated commands to exit and resisted being removed. His blood alcohol result later came back at 0.251.

This video walks through the preliminary examination, including the officer's testimony, cross-examination over the traffic stop and arrest, and the prosecution's request to add a fleeing-and-eluding charge.
The judge explained the issue plainly: “Physical violence is not necessary.”

The court found probable cause for resisting and obstructing and fleeing and eluding in the third degree, allowed the impaired-driving charge to be amended to high blood alcohol, and set bond at $11,000. The case was bound over to Circuit Court for further proceedings.
