The appellate court that sentenced the founder of pharmaceutical company Genencell to prison for alleged lobbying regarding new drug clinical trial approval stated in its ruling that "Kim Seung-won cooperated knowing that new drug development was a matter involving enormous financial gain."

The 7th Criminal Division of the Seoul High Court (Presiding Judge Gu Hoe-geun) pointed out in its ruling that "Broker Yang referred to National Assembly member Kim Seung-won as 'Oppa' (older brother) and spoke to the effect that he was a 'powerful figure' capable of exercising influence over the Ministry of Food and Drug Safety."

The court noted, "Genencell received approval for the clinical trial shortly after making the request through Kim Seung-won," adding, "Since soliciting for legitimate official duties is punishable as long as it involves monetary compensation, whether there was corruption in the approval process is irrelevant to the establishment of a crime."
