Smoking a cigarette absolutely doesn't cover up an alcohol smell. I'm a recovering alcoholic and this cop's analysis had me spit out my water laughing 😂😂
Its funny how the officers will insult your intelligence by saying "it doesn't work like you saw on tiktok" and then say you're being confrontational for not just doing what they want.
This trooper sunk his own case. He admitted there was no smell of alcohol and he didn't think this driver was impaired. Yet he tried to create the appearance of "totality of the circumstances" by throwing in smoking and drinking coffee, neither of which are signs of impairment... We all want impaired drivers off the road; but cops must do their jobs within the boundaries of our Constitution.
He may as well have said, "He was freshly showered and wearing clean clothes, which is what murderers do to hide the fact that they've just killed someone, therefore I arrested him for murder." The stupidity and lack of understanding what actual evidence is here is astounding. Cops need teaching the difference between "I don't know that you haven't..." and "I have reason to believe you have...". The first is an admission of no reasonable suspicion, not an excuse to fish for further evidence.
Why would the prosecutor even bring this to court? It's definitely multiple signs that he was pissed off because he knew the cop was trying to escalate. I think at some point, he knew the cop was fishing and he started to shut down.
