The theory is that the Hom-Dai doesn't "give" him these powers, he just "gains" them because he's undead and a High Priest.
In ancient Egypt when you die you dont just go to heaven or hell, your soul has to make a journey through the afterlife but your body must be cleansed, the mummification process, and you are usually buried with food, items, talismans and sometimes servants if you were rich, which help you through the journey.
Imhotep was given none of this, his body was not processed, he was buried with nothing, no food, no servants, no items, no talismans, nothing.
Because of that, he could not cross into the afterlife when he "Died", but he technically couldn't die because his soul would be "stuck" in his body.
And Imhotep is a high priest, he would know incantations and spells that would help him, so thats why they cut his tongue off.
This is why the Hom-dai was considered the worst punishment, you couldn't die.
It's not that they intended to "give" Imhotep these powers, they just never thought someone would be stupid enough to read from the book near his grave after they buried him alive and at the foot of Anubis to further "anchor" him there.
But time is a bitch and people forget and forgot.
So the theory is that when Eve read from the book, she wasnt breaking the Hom-Dai curse, she was just reanimating his body and his soul could finally take control
Especially where mummification is concerned and why Imhoteo was cursed.
The pharoah was considered to literally be the son of the gods. He was their living heir as well as his queen.
Harming the pharoah and or his family was punishable by death because you literally raised hands and weapons against one of the gods' own children.
Unfortunately, unlike Imhotep, Egypt wasn't immortal and it's civilization collapsed along with the memory and fear of his curse.
