A knock at the door, or a brown envelope on the mat. Your car was caught on a camera a fortnight ago, and somebody wants to know one thing: who was driving it? Your partner had the car that week, or your son borrowed it, or you genuinely cannot remember. So you do what this channel usually tells you — you say nothing. And this time that is exactly the wrong move. This is the one police question in England and Wales you are legally required to answer, and staying silent can put six points on your own licence for a car you were never driving.
Here is what we cover:
Road Traffic Act 1988, s.172 — "the person keeping the vehicle shall give such information as to the identity of the driver"
Why the duty is the keeper's, whether you were driving or not — and why anyone else who knows must answer too
The cost: 6 penalty points (code MS90, on your record for 4 years) and a fine of up to £1,000
Why that is double the minimum speeding penalty of £100 and 3 points
12 points in 3 years, and the new driver who loses their licence on 6
"What about the right to silence?" — the 2007 European Court of Human Rights ruling, 15 votes to 2
The one question, not all of them: the duty is the driver's identity and nothing more
The notice within 14 days, and the 28-day clock in s.172(7)
The four mistakes — and why "points swapping" is perverting the course of justice, maximum life imprisonment
When you genuinely don't know: the reasonable diligence defence in s.172(4), and how to prove it
Why the bar is higher for a company car
The sentence at the door, word for word, taken apart clause by clause
If it was you: the fixed penalty, the court letter, and the speed awareness course you only get if you answer
Everything here is tied to real sources — legislation.gov.uk, the Sentencing Council guideline, gov.uk's penalty points and speeding pages, and the CPS guidance on public justice offences — checked in October 2026.
One honest note. Nothing in this video is a way out of a speeding ticket. It is how not to turn a three-point ticket into six points, a court date, or a criminal record.
FREE HELP FIRST. If this ever becomes an interview under caution, ask for the duty solicitor. It is free, at any hour.
