Lo stesso vale per il diritto: la famiglia sarebbe superata nella società civile, e questa nello Stato - fandonia! La famiglia sussiste a dispetto della società civile, e questa a dispetto dello Stato, e quest'ultimo a dispetto di entrambe. La perpetua contrattazione che si svolge fra una miriade di ordinamenti giuridici (che in Italia fu purtroppo teorizzata da Santi Romano) è la palude del diritto pubblico e della politica che non conosce progresso. Quando il nostro Romagnosi conobbe la filosofia hegeliana della storia, domandò quale mai fosse la posizione dell'America - perché questa posizione non esiste. Pochi anni dopo Tocqueville andò in America per conosceere de visu la democrazia americana, e ci scrisse sopra due volumi fondamentali. Quando scrisse il "Capitale" nella biblioteca del British Museum senza avere mai visto una banca e una fabbrica, Marx scelse la strada intermedia fra Hegel e Tocqueville. Nondimeno, il "Capitale" rimase incompiuto senza superare l'opera del ciarlatano né del viaggiatore; e il compito di rabberciare il secondo e il terzo volume con l'antitesi della circolazione, e la sintesi della produzione-circolazione, toccò alla diligenza teutonica di Engels. Così il "superamento" dialettico fu realizzato mediante il glossema di un miracoloso trattino. E il miracolo si è ripetuto col glossema del "marxismo-leninismo", che dice tutto e non spiega un bel niente.
Per due secoli gli italiani si sono fatti incantare dalle tedescherie dei maghi del Nord (sebbene Melchiorre Gioja abbia detto che "l'Italia non s'inkanta"...). A dispetto dell'Istituto Italiano di Studi Filosofici di Napoli, che si ostina ad ammannirne gli incantesimi, credo proprio che bisognerebbe farla finita, una buona volta, e riconoscere che il celebre aforisma di Wittgenstein, per esempio, è una solenne scemenza. Quando affermò: "Aut tace, aut loquere meliora silentio" Salvator Rosa volle insegnare ciò che tutti già sanno: chi si esprime mediante immagini non sceglie di tacere su ciò che non può essere detto. Ma la cultura figurativa dei filosofi germanici è pressoché inesistente. E il protestantesimo ha avuto la sua responsabilità nel mettervi fine, soppiantando la visualità con la musica. Meritevolissimo sviluppo, s'intende - ma non fu un "superamento". E la vera sintesi fra le tre arti della parola, della visione e dell'ascolto avvenne in Italia in piena Controriforma. Che il melodramma e il teatro musicale italiano siano stati il "superamento" di quale contraddizione fra quale antitesi e quale sintesi ce lo dovrebbero spiegare gli accademici hegeliani che ancora si trascinano in qualche nostra Università. Ai filosofi del nostro sub-continente germanico che scrivono libri illeggibili, invece, è inutile porre un quesito che giudicherebbero fatuo.
