It's today's new philosophy. We have to make sure we do not offend anyone, which people like this take to mean they are entitled and allowed to make demands of their employer. This employer was more than fair and as the emails showed the plaintiff was constantly late or no show. Baby or not, just her work record is enough to fire her. Plaintiff needs to be introduced to responsibility.
I was a single mom and had no "village" to help when I was working 2 full time jobs. It is hard! Daycare years were the most difficult part of my parenting journey. I am a manager too and I can see both sides to this story. We need to have reliable staff too.
My employer would say the company is providing you with a job. It is your obligation to be there on time and work. Your childcare is not the employer responsibility
49 states are "at will employment" states. Unless she was fired for her gender, sexual orientation, race--some form of discrimination, the Defendant can fire the Defendant for any reason. It sounds like the Defendant DIDN'T fire her for "needing to pump", it was because the Plaintiff was constantly late, taking 45 minutes (instead of 20 minute breaks). And, she did say she spoke to the Plaintiff about it. Those are legitimate reasons for firing her. The Defendant even gave her a place to breastfeed, and took her shift, when she needed to do so. Then the Plaintiff complained about a lot of shifts, but SHE ASKED FOR MORE WORK. Plus, calling out the day of, is also grounds for dismissal.
So many women are not supported by the society. I worked for 30 years in elementary school as a teacher. They were so many teachers at one time that had to breast-feed and pump during work time and there was no place for us to do that. I literally had to go into a small closet and lock myself in there to pump. We are forced to go back to work because we need the money it’s really a very difficult time especially for your single mom especially if you don’t have a support system. My heart goes out to this woman because she’s trying her best. And it seems to me that the boss was doing her best as well to manage a business and to help this lady out since she was also a single mom once. I haven’t seen the rest of the show, but it is heartbreaking. So many people have no clue that this goes on. So many bosses they don’t know how many women have to really hustle to make things happen so they can show up. This is why women are amazing because we do make it happen in the end we figure things out. I hope this lady gets to support that she needs and finds a job that she’s capable of doing wow still being a single mom. Breast feeding a baby and having to work is such a balancing act!
Under the ACA, employers must provide a private space for breastfeeding, as well as time to do so. However this person was fired for attendance and bringing a baby in to the workplace. If it were a violation of accommodation, the appropriate avenue is an EEO complaint.

Where is the father of the baby and his family ? Why do these young women continue to lay down and let this happen when the men are not being supportive nor responsible. Support system ? She needs to call child support services and have his check garnished.
In my state the bar owner would have lost this case. You get your normal breaks and a 20 minute pump break. They also need to have some place private and sanitary for you to do it.
It’s a double edged sword. If you decline the shifts they get mad, if you take the shifts and although you need the extra money, it puts a huge strain. You feel you want to help out, plus you’re making more money. Should be win win. But sometimes it just gets too much. That’s besides the pumping thing.couldnt she have given her a warning? Complicated situation. And I agree, women should be able to be home with their babies for the first year.
It is NOT the responsibility of "the government" to pay for your time at home with your baby. The government does not give you ANYTHING without taking it from working people first. Do the responsible thing that was typical in this country a few generations ago and pay your own way!! The entitlement and expectation of this irresponsible generation is pathetic, so sad for innocent children.
