When I had enough of their lunacy, I pushed back with the actual LAWS on my side. The HOA board members did not expect me to push back so hard. I had recently retired from my 30 plus year career in the Marines, so my having pushed back hard was not an issue for me. This long standing combat veteran simply did Not take the BS which the local HOA board members had been dishing out.
I found HOA board members in my back yard, which was fenced, but they didn't care. I also found HOA board members messing with the exterior of my/our house. So I put an end to their having pushed their UN-Lawful weight upon me and mine. My retired Navy JAG Attorney friend had placed a rather large Lawsuit against the local HOA board members, and the larger HOA entity as well.
Of course the entire HOA desired to settle the matter without going to court. A wise move on their part. The local HOA board members had been Formerly advised by a Judge in good standing, via the appropriate Restraining Oder, to Not bother me/us again!. The local HOA board members did not heed the Restraining Order, so my Attorney switched gears, and the Lawsuit now went to Federal Court.
The Federal Judge simply did not take the polished BS of the HOA's legal counsel. What I had brought to the table, had been the our home's surveillance system's Video/Audio Recording, and the Still Camera photos I had taken. The Federal Judge found what had been brought before him, grossly offensive, be and with the actions and conduct of the local HOA board members.
The home office executives of the head HOA Office, found a real reason to halt what the local HOA board members had been doing, not only to me/us, but to many other residents as well. The local HOA board members had been fully removed, and that board had been fully dissolved. The new local HOA board members had fully taken over, fully rewriting our gated community CC&R's.
My family and I relocated to a NON-HOA Community, where our lives started a new, without those Deplorable and Deceitful Ex-HOA board members.
