O advogado de defesa dele vai tentar trazer a luz pro júri o lado positivo dele, uma boa oratória e os fatos que lhe pese cabe ao jurados e não a juíza, ela simplesmente vai fazer o papel caso seja culpado pelo jurados a juíza presidente da sessão vai fazer a dozimetria da pena de acordo com os crimes que ele responde. Lógico que tem juízes mais firmes isso não quer dizer que o juiz seja bom ou ruim ,são formas de trabalho e o juiz e todos que compõe o curpo do direito durante a sessão tem que ser imparciais.
