Here’s how the system can work: a US company lays off an American employee and brings in an H-1B worker through an Indian IT services company. That engineer may technically work on a Microsoft project through Infosys, but Infosys could subcontract the work to another company, which may subcontract it yet again. Believe me, such arrangements can go down three or four levels.
Now imagine how much the end client pays for that engineer versus how much the engineer actually receives after every intermediary takes its cut.
The real question is: how much bargaining power does that worker have when their visa status, job security and ability to stay in the US depend on their employment?
Not every H-1B worker faces this situation, and not every subcontracting arrangement is exploitative. But when workers are trapped in a chain of contractors with limited freedom to change jobs, the comparison to indentured labour deserves serious discussion.
The problem isn’t the nationality of the worker. It’s a system that can benefit corporations and middlemen while leaving workers vulnerable.
