Last night, the President of Portugal, António José Seguro, promulgated the new Portuguese nationality law. After a long period of parliamentary debates and two processes in the Constitutional Court, this decision on Portuguese citizenship is finally moving forward. Follow the latest news and the repercussions of this new legislation for those seeking Brazilian nationality.

On Sunday, May 3, 2026, President António José Seguro promulgated the new Nationality Law. Now, publication in the Official Gazette is needed, and the law will come into effect the following day. The text was approved after back and forth negotiations since October 2025, with 2 passages through the STF (Supreme Federal Court). The first version was rejected, mainly because it violated the principle of equality by providing for loss of nationality only for naturalized citizens in heinous crimes. In April 2026, the right wing approved a new version with PSD, Chega, IL and CDS, and Seguro promulgated it, registering discomfort due to the lack of consensus.

What changes. 1. Timeframe for naturalization by residence. For CPLP (Community of Portuguese Language Countries) and the European Union, it increases from 5 to 7 years. For other nationalities outside CPLP and the EU, it increases from 5 to 10 years. The count starts from the date of issuance of the residence permit. Waiting time at AIMA (Authority for Immigration and Citizenship) stops counting. 2. Children of foreigners born in Portugal. The legal residence requirement of one of the parents increases from 1 to 5 years and is no longer automatic. It now requires a formal declaration in the civil registry. There was no transition regime for new applications. 3. End of the Sephardic regime, closing the path for descendants of Sephardic Jews without residence in Portugal. 4. Marriage or stable union with a Portuguese citizen is maintained, with the possibility of naturalization after 3 years, with an effective link. 5. Great-grandchildren of Portuguese citizens gain access by ancestry, provided they have legally resided in Portugal for 5 years and prove an effective link. 6. New requirements for connection. In addition to language, they now include tests of culture, political organization and democratic values, and a solemn declaration. This part depends on regulation to come into practice.
