1. При продаже другому иностранцу покупатель получает только остаток 50-летнего срока, поэтому с годами цена для иностранцев падает. Бессрочное владение возникает только при продаже гражданину Вьетнама.
2. Продление ещё на 50 лет на практике пока никто не проходил, так что это право существует только на бумаге. Пошлины 0,5% за продление я в законе не нашёл, а 0,5% — это регистрационный сбор при оформлении розовой книги.
3. Розовая книга важнее, чем «психологический фактор». Застройщики нередко задерживают её годами, а если квота 30% уже выбрана, книгу не выдадут даже после полной оплаты.
4. Для домов и вилл действует отдельная квота: не больше 250 на район.
5. Строящийся кондотель иностранец купить не может, только арендовать (закон о недвижимом бизнесе 2023 года).
6. Не упомянуты расходы: НДС 10% (обычно уже в цене), 2% в фонд обслуживания, 0,5% регистрационный сбор и 2% от цены при продаже. Все платежи проходят только через вьетнамский банк.
Перед покупкой стоит проверить, есть ли проект в официальном списке для иностранцев и сколько осталось квоты, а также выдавал ли застройщик розовые книги по прошлым объектам. И лучше нанять независимого юриста, а не юриста застройщика.
