This traffic stop began after the driver was observed following another vehicle too closely and driving with an obstructed view. After speaking with the driver, the officer detected the odor of marijuana coming from the vehicle. When he asked about it, the occupants admitted to having a container of cannabis. Although marijuana was legal in the state, the container had already been opened instead of being kept in a sealed package, giving the officer probable cause to search the vehicle. So we thought.

After searching the vehicle they discovered over 100 lbs of Meth inside the door panels of the rented SUV. So this guy is in big trouble, he's heading to prison for 10 years + , right? Well, not so fast.

Prosecutors declined to bring charges in this case. Why? well we don't know for sure but it seems like there is some real doubt on whether there was probable cause to search the vehicle at all. The driver had declined consent to search, that means there needs to be probable cause to search the vehicle. Marijuana is legal in the state, so the question is if the blunt he had in the car was enough to warrant a probable cause search. Apparently it wasn't.
