Brother Grassley, I have never served in the legislative branch either just as brother Scalia has not. However, as an Idaho Farm boy, I can clearly state that a committee report cannot does not never will express the will of Congress the will of Congress is only expressed when it passes a law. A committee does not represent Congress. The committee cannot commit the entire Congress. So please please take this word of an Idaho Farm Boy a committee report does not represent the will of Congress.

It is refreshing to see a Supreme Court nominee at least answer intelligently these questions and discuss issues, rather than what we see today with nominees, who talk around every subject and basically provide no intelligent answers.

Grassley was either being intentionally thickheaded or sadly incapable of understanding the difference between a committee report (which has no benefit of a legislative vote) and legislation where representatives actually vote for/against the language of the bill. The last thing we need is legislation that is passed with ambiguities baked into the bill so some unelected faceless committee can interpret the law as they see fit for the courts to then be bound by.

Interesting testimony from Justice Scalia on the use of 'legislative history' at his nomination hearing. He seems to say that LH can be used sometimes - when reliable and documented. In later videos well into his term on SCOTUS, I thought I heard Justice Scalia say that legislative history, or anything besides the law text, should not be used in developing an opinion on a question of that law. That the reasons a law written and then enacted varies as the number of Congressmen voting on it. Methinks Scalia is attempting a sympathetic ear (or voice) to Senator Grassley.

Justice Scalia's aversion to legislative veto-type legislation isn't a question of legality, but it just makes work for the courts to interpret. I.e., when agencies are allowed broad and sweeping authority to issue regulations that call into question whether 1) the regulation was constitutional, and perhaps more common: 2) if the regulation meant the intent of the legislation. Case in point Mass v EPA when the court decided the Executive 'could' define Greenhouse Gases as a pollutant (subject to the Clean Air Act).
And that my friends was a real example of legislating from the bench, when the court tried to modify regulations to fit the Clean Air Act so that the resulting regulations "were not absurd." But alas, an argument for a different day.

It's amazing to listen to Grassley back then compared to today. He was so strong sounding back in the day. Today, 40 years later and STILL in there, he sounds really feeble. Yet, he IS in his 90's.
