ELISSON'S DEATH OCCURRED IN 2011, IN THE CAMPO DO SANTANA NEIGHBORHOOD, CURITIBA METROPOLITAN AREA. THE CRIME WAS COMMITTED ON A STREET NEAR THE HOME OF THE VICTIM ELISSON AND THE ACCUSED SILVIO, AND THERE WERE NO EYEWITNESSES. The investigation was based on the testimony of a confidential witness, who reported having witnessed the accused, Silvio, making threats against the victim.

Silvaio already has other convictions and charges, such as bicycle thefts during his adolescence. Silvio mentions that he heard the gunshots and fled for fear of being the next victim. The accused says his name was involved in the crime because his brother wants to take his land.

DETAILS OF THE CONVICTION

IN ANSWERING THE SERIES OF QUESTIONS, THE JURORS REACHED THE FOLLOWING CONCLUSION:

LINE A: ACKNOWLEDGE THE EXISTENCE OF THE FACT;

LINE B: ATTRIBUTE AUTHORSHIP TO THE DEFENDANT;

LINE C: DO NOT ACQUIT THE ACCUSED; AND FINALLY

LINE D: ACKNOWLEDGE THE QUALIFYING CIRCUMSTANCE OF BASE MOTIVATION, WITH THREE POSITIVE ANSWERS.

IN VIEW OF THE FOREGOING AND IN ATTENTION TO THE JURY, THE ACCUSATION IS DEEMED VALID. In effect, the defendant Silvio Roberto Rodrigues da Cruz is convicted of the conduct foreseen in Article 121, Paragraph 2, Item I of the Penal Code, that is, for aggravated homicide.

Item 4: Sentencing

The final sentence is hereby set at 16 years and 6 months of imprisonment, in a closed regime.

The crime occurred in a public place, Rua Tenente Coronel Arlindo Cândido Molina, Campo do Santana neighborhood, in Curitiba, and there were no witnesses to the event nor any video footage.
