Force majeure used to be invoked only for catastrophic and unforeseeable events that prevent contract fulfillment. Terrorist attacks, natural disasters, pandemics. Not regulatory hurdles and foolish business decisions.

Oracle would become like IBM in the 2010s, a company that enterprise clients have to use for legacy maintenance, but no startup or innovator chooses to build on. This is their fate. A slow corporate decay into irrelevance within a decade.

I got involved in activism to stop a local data centre in our rural Scottish community. 3 politicians and a police sergeant all showed up to support us! The energy was great and we have ideas for how to both raise awareness and get into the room in parliament.

It’s the opposite of force majeure, “an act of God happened so we can’t pay you”, what they are really saying is that “unless there’s an act of God you won’t be getting fully paid back”.
