Sen. Cory Booker criticises Republicans over their questioning of former Special Counsel Jack Smith, accusing them of prioritising Donald Trump over the Constitution. Booker also apologised to Smith and his family at the end of his remarks.

Former Special Counsel Jack Smith is testifying today, Tuesday, September 29, 2026, before the Senate Judiciary Committee. The hearing, titled “Oversight of Jack Smith's Abuse of Authority and the Targeting of Republicans and Related Matters,”
Led by Judiciary Committee Chair Senator Chuck Grassley, Republican lawmakers are intensifying their focus on the investigative tactics used during the federal investigations into Donald Trump. A primary area of inquiry is "Arctic Frost"—the federal probe that preceded the election-related prosecution—and investigators' efforts to obtain communication and phone records belonging to members of Congress.
The hearing follows accusations from House Judiciary Chairman Jim Jordan, who referred Smith to the Justice Department alleging that Smith made false statements during a previous closed-door deposition regarding the acquisition of lawmakers' records. Smith's legal team has firmly denied these allegations, stating he testified truthfully.
In his testimony, Smith strongly defended his decisions to bring federal charges against Trump for attempting to overturn the 2020 election and mishandling classified documents. Smith stated, "Our investigation developed proof beyond a reasonable doubt that President Trump engaged in criminal activity," adding that he would make the same decision to prosecute today regardless of political party.
